When an issue arises in the workplace, be it minor or major, witnesses play an important role in intervening or reporting the incident. But what happens when witnesses become bystanders by not intervening?

As an employer, it's crucial to understand who is a bystander, why they might not report what they witnessed, what they can do to intervene and why anonymous complaints should be take seriously. Recognizing the role of employers play in empowering their employees can create a safer, happier and more harmonious workplace.

Fiona H. McFarlane

Fiona H. McFarlane leads KSW's Workplace Investigation team, assisting clients when discord occurs in the workplace by conducting third-party, neutral investigations and assessments using culturally and trauma informed practices. Fiona aims to provide employers with information and legal analysis so balance can be restored in the workplace through sustainable solutions.

Fiona’s primary areas of practice are workplace investigations, employment contracts and workplace policies, human rights, disability issues, administrative law, legal drafting, analysis and strategy, as well as compliance and governance matters. She has extensive experience working with businesses and other large institutions throughout Western Canada, particularly in investigations, human rights, policy work, regulatory matters and culturally sensitive topics, including Indigenous matters.
